Terms of Service - aivideogenerator.dk

These Terms of Service (“Terms”) govern your use of aivideogenerator.dk (the “Service”). By creating an account, purchasing credits, or clicking Generate video, you agree to these Terms.


1) Who we are & how to contact us

Languages: We may publish localized versions. If a translation conflicts with this document, the English version prevails.

Charge descriptor: Your card/bank statement may display ELOQUENT LABS GROUP LLC.


2) Eligibility & accounts

  • You must be of the age of majority in your country. The Service is not intended for children.
  • Both business (B2B) and consumer (B2C) use are allowed.
  • You are responsible for safeguarding your account and for all activity under it.

  • 3) What we provide

    We provide an online AI video generation Service. You buy credits and spend them to request generations (renders). We use third‑party AI model providers and infrastructure. Models and providers may change over time. Typical fulfilment time for a generation is 3–9 minutes; in rare cases it may take longer.


    4) Visibility: private vs. public

  • Private by default. Unless you explicitly opt in, your generations remain private.
  • Public (Explore) opt‑in: If you publish an item to our Explore page, you grant us a worldwide, non‑exclusive licence to host, display and showcase that item on our site and social channels with minimal formatting (e.g., thumbnails). You can unpublish at any time. We may occasionally offer discounts/credits for opting in; the amount and availability may vary.
  • Hosting window: Private items may be deleted from our storage 7 days after generation. Public items may remain longer but can be removed for policy or operational reasons.

  • 5) Acceptable Use

    You must follow our Usage Policies at /usage-policies (incorporated by reference). Among other things, you must not:

  • post or generate illegal content; sexualized content involving minors; non‑consensual intimate imagery; unlawful hateful or terror content; or content that infringes third‑party rights;
  • impersonate a person without consent; misuse personal data; violate sanctions/export control; or spam/scrape the Service;
  • upload or prompt from copyrighted materials unless you have the necessary rights.
  • Automated safety. We and/or our providers use automated filters. If a job is blocked, it is cancelled and credits are re‑granted. There is no routine human pre‑review; we may review items you publish publicly or that are reported to us.


    6) Pricing, credits, expiry & refunds

  • Credits & pricing: See the live Pricing page. As a guide only, ~100 credits may purchase ~8 s at 1080p with audio on certain models; actual pricing varies.
  • Expiry: Bonus/free credits expire 1 month after grant (unless stated otherwise). Purchased credits expire 12 months after purchase.
  • Failed renders: Not charged or promptly re‑credited.
  • Refunds: Purchases are generally non‑refundable. See /refund-policy for any exceptions; contact support for case‑by‑case review.

  • 7) Orders, payment‑obligation wording & right of withdrawal (EEA consumers)

  • Purchasing credits: The final checkout button is labelled “Order with payment obligation.”
  • Starting a generation: When you click Generate video, performance begins. Before starting, we ask you to confirm that (1) you expressly consent to start immediately and (2) you acknowledge that your 14‑day withdrawal right ends once generation starts. We include a copy of this consent/acknowledgement in your receipt/confirmation.
  • If you do not give this consent/acknowledgement, we will not start the generation.

  • 8) Quality, non‑conformity & remedies

  • The Service is provided on a best‑efforts basis with no guaranteed service levels.
  • If a clear technical issue on our side caused your specified inputs (e.g., prompt/settings) not to be used, we will re‑credit your account and invite you to retry.
  • Artistic differences, stochastic variation, or unmet creative expectations are not non‑conformity.

  • 9) Intellectual property

  • Your inputs (prompts/uploads). You retain your rights. You grant us a licence to process them to provide the Service and, if you opt in to publish, to host/display publicly.
  • Generated outputs (videos). You own your outputs (subject to any third‑party rights). We do not provide IP clearance, model releases, or music sync rights.
  • Similarity / non‑exclusivity. Outputs may be similar to content produced for others.

  • 10) Third‑party services

    We rely on third‑party providers (e.g., model hosts, storage/CDN, authentication, payments, analytics). The current list and details are maintained in our Privacy Policy. Provider restrictions may apply to your use; we may need to block certain uses to stay compliant.


    11) Security, rate limits & misuse

    We use encryption in transit and at rest where possible, least‑privilege access, and quiet fair‑use rate limits to protect the Service.


    12) Reporting & account actions

    Report illegal content or IP claims to [email protected] (subject: REPORT). If we remove or restrict content or accounts, we will provide a brief statement of reasons. After three upheld violations, we may close your account; for serious violations, funds/credits may not be refunded.


    13) Suspension, termination & effect

    We may suspend or terminate accounts for unlawful use, chargeback abuse, spam, scraping, or repeated policy breaches. On termination you may download existing private items for a short window (typically a few days) before they expire and are deleted. If no further issues arise, we may refund remaining paid credits to the original payment method after a 90‑day hold.


    14) Warranties & disclaimers

    The Service is provided “as is” and “as available.” AI is probabilistic; outputs may be inaccurate or biased. Do not rely on outputs as factual, error‑free, or fit for a particular purpose. Nothing in these Terms excludes liability where doing so would be unlawful, and nothing limits your mandatory consumer rights under applicable law.


    15) Indemnity (from users)

    You agree to indemnify and hold harmless Eloquent Labs Group LLC and its affiliates for third‑party claims arising from your inputs or use of outputs (e.g., copyright, personality/publicity, defamation), except to the extent caused by our breach of these Terms.


    16) Liability cap (B2B only)

    For non‑consumer (B2B) customers, our aggregate liability for the Service is limited to the total amounts you paid for the Service in the 12 months preceding the event giving rise to the claim. Indirect, incidental, special and consequential damages are excluded to the extent permitted by law.


    17) Governing law, venue & consumer protections

    These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict‑of‑laws principles. Venue for B2B disputes lies in the state or federal courts located in Delaware. If you are a consumer resident in the EEA, you also benefit from mandatory consumer protections of your home country; this clause does not deprive you of those rights.


    18) Changes to these Terms

    We may update these Terms to reflect changes in law, providers, or features. We will post the updated version and, for material changes, notify you by reasonable means. Continued use after the effective date constitutes acceptance.
