Privacy Policy - aivideogenerator.dk

This Privacy Policy explains how Eloquent Labs Group LLC (“Eloquent”, “we”, “us”, “our”) processes personal data when you use aivideogenerator.dk (the “Service”).

1) Who is the controller & how to contact us

Controller: Eloquent Labs Group LLC, 167 Madison Avenue, New York, NY 10016, USA.

Technical provider (processor): LV Consulting, Dortheavej 3, st. 11, 2400 København NV, Denmark - CVR DK44020076.

Email: [email protected] (subject: Privacy).

2) What this policy covers

This policy applies to the website, account area, purchase flows, the generation process (prompts, reference images, outputs), support interactions, and public sharing on our Explore page.

3) Data we process

  • Account data: email, display name, password hash, VAT/tax number (if you enter it).
  • Transaction data: purchase amount, currency, billing country, VAT info, invoice details, masked payment info, timestamps.
  • Generations: prompts, optional reference files, model settings, and outputs.
  • Usage & device data: IP address, timestamps, pages/events, error logs, coarse location (from IP), cookie IDs.
  • Support data: messages and attachments related to assistance or reports.
  • Children: We do not target children. Where a child’s consent is relevant for information‑society services, local rules apply (e.g., DK 15; SE/FI 13).

    4) Why we process data & legal bases (GDPR Art. 6, where applicable)

  • Provide the Service (contract): create/manage accounts, credit balances, render videos, store/deliver outputs, send receipts.
  • Payments & accounting (legal obligation/contract): invoicing, tax, fraud prevention; keep records as required by bookkeeping rules.
  • Safety & moderation (legal obligation/legitimate interests): act on reports, operate automated content filters, keep minimal audit logs.
  • Analytics & product improvement (legitimate interests or consent): understand feature use and improve UX; non‑essential cookies/analytics run only with consent.
  • Marketing (consent): optional product emails; you can unsubscribe anytime.
  • Compliance & claims (legitimate interests/legal obligation): handle takedowns, chargebacks, and disputes.

  • 5) Generations: private vs public & retention

  • Private by default. Private items may be automatically deleted from our storage ~7 days after creation.
  • Public (Explore): only if you explicitly opt in. Public items remain until you unpublish or we remove them for policy/operational reasons.
  • If a generation is blocked by automated filters, the job is cancelled and credits are re‑granted. There is no routine human pre‑review.
  • Some model providers may embed invisible AI watermarking in outputs as a safety feature; we do not use this for user tracking.

  • 6) How long we keep data

  • Account data: while your account is active; deleted or anonymised on request, subject to legal holds.
  • Invoices & records: typically 5 years from the end of the financial year (or longer where law requires).
  • Private generations: typically ≤7 days (operational window), then deletion from active storage.
  • Public generations: until you unpublish or request deletion.
  • Logs & security events: typically ≤12 months, longer if needed for incidents or legal reasons.
  • Support tickets: ≤24 months after closure unless needed longer for disputes.

  • 7) Service providers (processors) & other recipients

We use trusted providers to operate the Service. We keep this list current here.

International transfers. When personal data leaves your country (including transfers from the EEA/UK to the USA), we use appropriate safeguards such as the European Commission Standard Contractual Clauses (SCCs) and, where a provider participates, the EU‑US Data Privacy Framework (DPF). We also apply additional measures like encryption at rest/in transit and data minimisation where appropriate.

    8) Cookies & similar technologies

  • Essential cookies keep you logged in and secure and are required for the Service.
  • Analytics/marketing cookies run only with your consent via our banner. You can withdraw consent at any time in the banner settings.

  • 9) Your rights

Subject to local law, you can access, rectify, delete, port and restrict your data, and object to processing (especially analytics/marketing). Where we rely on consent, you can withdraw it at any time. EEA residents can also complain to their local data protection authority.

To exercise your rights, email [email protected]. We may need to verify your identity.

    10) Security

We use encryption in transit and at rest where possible, least‑privilege access, rate‑limit and abuse controls, and continuous monitoring. If we detect misuse, we may temporarily suspend activity to protect users and the Service.

    11) AI‑specific transparency

You are responsible for labelling AI‑generated content where laws or platform rules require it. We do not use your private content to train our own models; if that ever changes, it would be opt‑in only.

    12) Changes to this policy

We may update this policy as our Service or laws change. We will post the updated version and, for material changes, notify you by reasonable means.
